1. General

These Terms and Conditions form a legally binding agreement between Jason O’Rourke (“the Owner”, “we”, “our”, or “us”) and the person who signs the booking form or completes the online booking and payment (“the Hirer”, “you”, or “your”).

The Hirer is responsible for ensuring that all members of the travelling party understand and comply with these Terms and Conditions.

The vehicle covered by this agreement is Paul the Campervan.


2. Bookings

A booking deposit is payable within 2 days of a provisional booking being made.

A booking remains provisional until:

  1. The booking deposit has been paid in full and cleared through the banking system (where applicable);

  2. The Hirer has provided all documentation required to validate their driving licence and address in accordance with our self-drive hire insurance policy; and

  3. The Hirer has confirmed that they have read, understood, and agree to the Privacy Notice and Vehicle Tracking Policy applicable to the hire of the vehicle.

Until the booking is confirmed, we reserve the right to cancel the provisional booking without notice.

The remaining hire balance and any required security deposit must be paid no later than 14 days before the start of the hire period.

All required documentation must also be provided and approved no later than 14 days before the start of the hire period.

Failure to pay the balance, provide the required documentation, or confirm acceptance of the Privacy Notice and Vehicle Tracking Policy by the applicable due date will be treated as a cancellation by the Hirer.

Bookings made less than 14 days before the hire period must be paid in full at the time of booking.


3. Driver Eligibility and Required Documents

To comply with our insurance requirements, the Hirer must provide:

  • A valid driving licence; and

  • Two proofs of address.

Acceptable proofs of address include:

  • Electricity bill or statement

  • Water bill or statement

  • Gas bill or statement

  • Broadband or landline bill

  • Council tax bill

  • TV licence

  • Bank statement

  • Credit card statement

  • Mortgage statement

  • Polling card

  • HMRC self-assessment or tax credit documentation

  • Student loan correspondence

  • Shotgun licence

  • Payslip

  • Mobile phone bill

  • Pension correspondence

  • Car finance statement

  • Loan statement

  • Property deed

An annual council tax bill is acceptable. All other documents must be dated within the previous 3 months.

UK licence holders must provide:

  • A copy of the photocard driving licence (front and back); and

  • A valid DVLA check code.

The booking is not confirmed until all documents have been received and approved.


4. Security Deposit

A refundable security deposit will be required before the start of the hire period.

The deposit may be used to cover, including but not limited to:

  • Damage to the vehicle;

  • Missing or damaged equipment;

  • Additional cleaning;

  • Fuel shortages;

  • Late return charges;

  • Traffic fines;

  • Tolls;

  • Congestion charges;

  • Other penalties; and

  • Reasonable administrative costs incurred during or as a result of the hire period.

Any undisputed balance of the security deposit will be returned within 7 days of the vehicle being returned and inspected.

We may retain part or all of the security deposit where reasonably necessary until outstanding damage claims, traffic fines, tolls, penalties, or other charges relating to the hire period have been resolved.


5. Cancellation by the Hirer

Cancellation must be made in writing, including by email, to:

Cancellation charges will apply in accordance with the cancellation policy published on our website or booking confirmation.

We strongly recommend that you obtain suitable holiday cancellation insurance.


6. Cancellation by the Owner

We will make every reasonable effort to provide the booked vehicle for the agreed hire period.

If, due to circumstances beyond our reasonable control, including mechanical failure, accident damage, theft, or other unforeseen events, the vehicle becomes unavailable, we reserve the right to cancel the booking.

In such circumstances, you will receive a full refund of all monies paid.

Our liability is limited solely to the refund of monies paid. We shall not be liable for any indirect, consequential, or additional losses, including travel, accommodation, or holiday expenses.


7. Vehicle Collection and Return

The vehicle will normally be available for collection between 14:00 and 18:00 on the first day of the hire period.

The vehicle must be returned by 11:00 on the final day of the hire period.

If the Hirer is delayed and expects to arrive outside the agreed collection period, they must notify us as soon as reasonably possible. We cannot guarantee collection outside the stated collection window unless agreed in advance.

Late returns may result in additional charges, including but not limited to:

  • Additional hire charges;

  • Administrative costs; and

  • Costs arising from disruption to subsequent bookings.

Collection instructions will be provided after full payment has been received.


8. Permitted Drivers

Only drivers specifically approved by our insurance policy and named on the booking may drive the vehicle.

The Hirer must not permit any unauthorised person to drive the vehicle.


9. Use of the Vehicle

The vehicle must not be used:

  • For any illegal purpose;

  • For racing, competitions, or speed testing;

  • For carrying passengers for hire or reward;

  • For towing unless expressly authorised in writing;

  • Off-road other than on recognised campsites or suitable access roads;

  • By any person under the influence of alcohol or drugs; or

  • In a manner that would invalidate our insurance policy.

The vehicle must not be sublet, assigned, or otherwise transferred to another person.

The Hirer must comply with all applicable road traffic laws and regulations during the hire period.


10. Number of Occupants

The maximum number of occupants is 3 persons.

Only those persons named on the booking are permitted to travel and stay in the vehicle.

Exceeding the maximum occupancy will be treated as a breach of this agreement and may result in immediate termination of the hire without refund.


11. Pets

Pets are permitted only with prior agreement.

All pets must be house trained.

Pets must not:

  • Be left unattended in the vehicle; or

  • Be allowed on beds or upholstered furnishings.

The Hirer is responsible for all damage, additional cleaning, or odour removal resulting from pets.


12. Smoking and Vaping

Smoking and vaping are strictly prohibited inside the campervan.

A charge will be made for specialist cleaning and odour removal where this condition is breached.


13. Fuel Policy

The vehicle will be supplied with an agreed level of fuel and must be returned with the same level of fuel.

If the vehicle is returned with less fuel than supplied, the cost of refuelling plus a reasonable administration charge may be deducted from the security deposit.


14. Mileage

The hire includes any mileage allowance specified in your booking confirmation.

Any excess mileage will be charged at the rate stated in your booking confirmation.


15. Cleaning

The vehicle must be returned in a clean and tidy condition, including:

  • Removal of all rubbish;

  • Washing of used crockery and utensils; and

  • Emptying of waste water and toilet waste where applicable.

Returning the vehicle in an excessively dirty condition may result in additional cleaning charges.


16. Damage and Breakages

The Hirer must take reasonable care of the vehicle and all fixtures, fittings, equipment, and contents.

Any damage, accident, loss, or breakage must be reported to us as soon as reasonably practicable and, in any event, no later than 24 hours after the occurrence.

The Hirer is responsible for any loss or damage caused during the hire period, subject to the terms of the insurance policy and any applicable insurance excess.

Fair wear and tear will not be charged.


17. Accidents, Theft, and Breakdown

In the event of an accident, theft, fire, or damage:

  • Contact us immediately;

  • Contact the police where required;

  • Do not admit liability;

  • Obtain details of any third parties involved; and

  • Complete any accident report documentation we require.

The Hirer must cooperate fully with insurers and authorities.

Breakdown assistance details will be provided at vehicle handover.

The Hirer must not arrange repairs without our prior consent unless emergency repairs are necessary to prevent further damage or to ensure the safety of the Hirer, occupants, or other road users.


18. Insurance and Excess

The vehicle is insured under a self-drive hire insurance policy, subject to the terms, conditions, exclusions, limitations, and insurance excess applicable to that policy at the time of hire.

The Hirer is responsible for the applicable insurance excess in the event of damage, theft, or loss where the Hirer is liable under the insurance policy.

The Hirer must comply with all insurance requirements and cooperate fully with us and our insurers in the event of any claim.

Nothing in these Terms extends or alters the cover provided by the vehicle's insurance policy.


19. Traffic Offences and Charges

The Hirer is responsible for all:

  • Parking charges;

  • Speeding fines;

  • Toll charges;

  • Congestion charges;

  • Low Emission Zone or Clean Air Zone charges;

  • Bus lane penalties; and

  • Any other fines, penalties, or administrative charges incurred during the hire period.

Where we receive such charges after the hire period, we may charge the Hirer the amount of the charge together with a reasonable administration fee.


20. Vehicle Tracking

For insurance, security, theft prevention, and vehicle management purposes, the vehicle is fitted with a GPS tracking device.

Location, movement, and speed-related data may be recorded during the hire period.

The tracking system may generate notifications relating to vehicle location, movement, speed, ignition status, and security events.

21. External CCTV

For the security and safety of the vehicle and its occupants, external CCTV cameras are fitted to the campervan.

The CCTV system is provided primarily as a security and safety feature for the benefit of the Hirer and occupants. The cameras are positioned to monitor the exterior of the vehicle and may capture images of the surrounding area and individuals who come within the cameras’ field of view.

A CCTV monitor is provided inside the campervan for the Hirer’s use, allowing the Hirer and occupants to view the external camera feeds and assist with monitoring the immediate surroundings of the vehicle, particularly when the vehicle is parked or occupied.

The cameras do not monitor or record the interior of the campervan, and no audio is recorded.

The CCTV system may operate while the vehicle is stationary or in use, including when parked or left unattended, where appropriate for security and vehicle protection purposes.

CCTV recordings may be accessed and used where reasonably necessary for purposes including:

  • Protecting the vehicle and its occupants against theft, damage, or vandalism;

  • Assisting the Hirer in monitoring the immediate external surroundings of the vehicle;

  • Investigating accidents, incidents, or suspected misuse;

  • Supporting insurance claims;

  • Investigating or defending legal claims; and

  • Assisting law enforcement or other competent authorities where legally required or permitted.

CCTV recordings will be retained only for as long as reasonably necessary for the purposes for which they were collected, in accordance with our Privacy Notice and Data Retention Schedule.

By confirming the booking, the Hirer acknowledges that the vehicle is fitted with external CCTV and that an internal monitor is provided for the Hirer’s use as part of the vehicle’s security and safety equipment. The Hirer also acknowledges the processing of personal data as described in the Privacy Notice.


22. Liability

Personal belongings remain entirely at the Hirer’s risk.

We shall not be liable for:

  • Loss or damage to personal property;

  • Missed travel connections;

  • Holiday disruption; or

  • Consequential or indirect losses.

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any liability that cannot legally be excluded or limited.

Children remain the responsibility of the Hirer at all times.


23. Owner’s Rights

We reserve the right to refuse the hire where, in our reasonable opinion, the Hirer is not suitable or capable of safely operating the vehicle.

We may terminate the hire without refund where:

  • The vehicle is being misused;

  • These Terms are breached; or

  • The Hirer behaves in a dangerous, abusive, illegal, or unreasonable manner.

We reserve the right to enter the vehicle at a reasonable time where necessary in an emergency, for safety reasons, or where remedial repair or maintenance is reasonably required.

Where reasonably practicable, we will notify the Hirer before entering the vehicle.


24. Complaints

Any problem with the vehicle, its equipment, or the hire service must be reported to us as soon as reasonably practicable during the hire period, so that we have a reasonable opportunity to investigate and, where possible, rectify the issue.

The Hirer must provide reasonable assistance and access to the vehicle where necessary to enable us to investigate or rectify a reported problem.

Complaints made only after the hire has ended may not be accepted where the Hirer has failed to give us a reasonable opportunity to investigate or remedy the issue during the hire period.


25. Governing Law

These Terms and Conditions are governed by the laws of England and Wales.

Any dispute arising from this agreement shall be subject to the jurisdiction of the courts of England and Wales, subject to any applicable statutory rights of the Hirer.


Acceptance of Terms

By paying the booking deposit or hire balance, or by taking possession of the vehicle, the Hirer confirms that they:

  • Have read and understood these Terms and Conditions;

  • Agree to be bound by these Terms and Conditions;

  • Have read and understood the Privacy Notice;

  • Have read and understood the Vehicle Tracking Policy;

  • Acknowledge that the vehicle is fitted with GPS tracking and external CCTV;

  • Acknowledge that the external CCTV system includes an internal monitor for the Hirer’s use; and

  • Acknowledge the processing of personal data as described in the Privacy Notice.

The Hirer confirms that the information and documentation provided in connection with the booking is accurate and complete.
